Oral Arguments Heard In Major Superfund Cases


















On February 24, 2009 The Supreme Court heard oral arguments in Burlington No., & Santa Fe R. Co., v. United States, Docket No. 07-1601 and Shell Oil Co., v. United States, Docket No. 07-1607 regarding liability for a Superfund site in Arvin, California. Transcript is available here.

Supreme Court To Hear Oral Arguments: Burlington No., & Santa Fe R. Co., v. United States, and Shell Oil Co., v. United States


The Supreme will hear oral arguments on Tuesday February 24, 2009 (morning session) in the combined cases of Burlington Northern v. US and Shell Oil Company v. US (Briefs).

This is a landmark case in CERCLA law regarding owner and arranger liability in areas where there have been numerous splits in the Circuit Courts.

The case revolves around a pesticide contamination site near Bakersfield and will be of great interest to landowners and manufacturers of products across the country.

Shell Gets US High Court Hearing on Cleanup Suits
